Mamdani Demands ICE Halt After Marble Hill Shooting

A federal immigration officer shot a Dominican man in the neck as he drove a car with a 5-year-old boy inside Thursday afternoon in Marble Hill. By Friday, the city’s mayor was demanding that Washington stop enforcing federal immigration law in New York altogether.

Mayor Zohran Mamdani called for ICE to be abolished after Oscar Belgal was shot. He said the agency undermines public safety and urged the Trump administration to halt immigration enforcement operations in the city. He called the shooting an outrage.

What Federal Officials Say

The Department of Homeland Security offered a different account. It said officers were conducting a “targeted enforcement operation” to arrest Belgal, whom it described as a “criminal illegal alien” with a grand larceny conviction and a history of other arrests.

Key questions remain unanswered. Officials said the officer shot Belgal in the neck while he was behind the wheel, with a young child in the vehicle. The basic facts don’t explain what happened just before the shot or why the officer fired. An investigation, not a press conference, should settle those questions.

The Mayor’s Demands

Mamdani said he spent two hours Thursday night pressing President Donald Trump and Homeland Security Secretary Markwayne Mullin to release the wounded man and stop immigration enforcement operations in the city. His request reached well beyond the shooting itself: it asked the federal government to suspend enforcement of laws passed by Congress within the nation’s largest city.

The mayor said the night ended without a concession. Federal authorities removed Belgal from the hospital late Thursday night and took him away, Mamdani said. He didn’t say where they took him.

Gov. Kathy Hochul, also a Democrat, said she delivered a similar message to Trump and Mullin by phone. Her involvement shows the dispute isn’t confined to City Hall. Both of the state’s top Democratic officials have personally lobbied the White House and the Homeland Security chief over a single enforcement action.

Enforcement and Its Limits

The sequence raises a basic question: who decides which laws get enforced? Federal immigration statutes don’t exempt cities that oppose them. DHS says it was pursuing a man with a criminal conviction on his record, precisely the category of person even many critics of aggressive enforcement say should be the priority. Whether officers conducted this operation properly is separate from whether the agency should exist.

A call to abolish ICE outright also leaves consequences unaddressed. Eliminating the agency wouldn’t eliminate the underlying statutes, and it wouldn’t answer what would replace ICE or who would handle cases like the one DHS says it pursued Thursday.

Why This Matters:

The Marble Hill shooting puts two things in tension: a child in a car and a gunshot wound on one side, a federal agency’s claim that it was pursuing a convicted offender on the other. Both deserve a full, transparent accounting. A thorough investigation, not a political negotiation by phone, is the proper venue. What happens next will also test how far a city’s leaders can go in resisting federal law enforcement. If New York’s officials can demand a halt to federal operations by calling the White House, the principle of uniform national law gets harder to defend. Taxpayers in New York and elsewhere will want to know whether the rules apply evenly, and whether public safety is served by abolishing an agency or ensuring it follows clear procedures.
