A federal judge has dismissed the seditious conspiracy case against members of the far-right Oath Keepers extremist group, effectively closing the book on major Jan. 6 prosecutions. This ruling arrives as the Department of Justice, 4 months ago, vacated convictions for Oath Keepers founder Stewart Rhodes and others who received commuted sentences but no pardons. Meanwhile, the state's immigration apparatus has detained over 50 parents and spouses of active-duty service members since Trump took office for a second term, deporting at least six and forcing one self-deportation.
Justice for Whom?
U.S. District Judge Amit Mehta reluctantly dismissed the seditious conspiracy case, criticizing efforts to rewrite the history of the Jan. 6 attack on the Capitol. Judge Mehta wrote in his ruling that the government "asks to absolve these Defendants of crimes against the United States itself." This dismissal follows President Donald Trump’s sweeping pardons and commutations last year, which wiped out numerous Jan. 6 cases. The state, through its executive and judicial branches, has systematically dismantled legal accountability for those who sought to disrupt the transfer of power. This selective application of justice reveals whose interests the state truly serves. It isn't the working class, nor those who challenge the established order from below.
The State's Border Apparatus
While the state absolves those who attacked its Capitol, it aggressively targets the families of its own military personnel. More than 50 parents and spouses of active-duty service members have been detained. At least six have been deported. One individual self-deported. These detentions occurred under Trump’s immigration crackdown, a policy framework designed to control and suppress labor, particularly from immigrant communities. The government itself does not track such detentions, obscuring the full scope of its actions. The Department of Homeland Security issued a statement claiming, "DHS and ICE value the contributions of all those who have served in the U.S. military." It added, however, that "U.S. military service alone does not automatically grant lawful immigration status, or exempt aliens from the consequences of violating U.S. immigration laws." This statement lays bare the state's priorities: military service is valued only insofar as it serves the imperial project, not as a basis for basic human dignity or family unity.
Imperial Costs, Domestic Control
Experts warn that these reversals could undermine military preparedness. This concern arises even as the U.S. is at war in Iran, a conflict driven by imperial ambitions and the securing of resources and markets for transnational corporations. The state demands military service to project its power abroad, yet it simultaneously inflicts hardship on the families of those who serve. The contradiction is stark. The system functions to concentrate wealth upward and maintain control, whether through selective justice for political allies or through the systematic underpayment of labor and the brutal enforcement of immigration laws against the dispossessed. The state's actions demonstrate its unwavering commitment to protecting accumulated wealth and suppressing any organized challenge to the existing distribution of power, even when those challenges come from within its own ranks or from the families of those it sends to war.
