Criminal charges against former Olympic canoeist David Hearn, accused of deliberately damaging the Lincoln Memorial Reflecting Pool, were dropped Friday, despite President Donald Trump’s insistence that the monument suffered from vandalism. This decision by U.S. Attorney Jeanine Pirro’s office comes after a $14.7 million no-bid renovation project, leaving taxpayers with a damaged national symbol and a deepening institutional blame game.
President Trump sharply criticized Pirro’s assessment on Truth Social, stating, “I disagree 100% with Jeanine Pirro, the U.S. Attorney for the District of Columbia, on the Reflecting Pool.” He questioned her judgment, adding, “I don’t know what she was thinking?” The President maintained that while there “may have been some contractor difficulty,” the “major damage was caused by VANDALS!” He called it “a pure case of VANDALISM,” pointing to large “86 47” lettering emblazoned on the surrounding grass as evidence of deliberate defacement.
Institutional Failure and Blame
Pirro’s office, however, filed court documents asserting that additional information from the Interior Department revealed the damage stemmed from a botched installation by contractor Atlantic Industrial Coatings (AIC). The filing cited a rushed completion ahead of the America 250 celebration in the weeks surrounding Independence Day 2026. A recent visual inspection, according to Pirro, showed widespread damage, even in the middle of the pool, where a vandal would be unlikely to peel the lining. She concluded that, given this new information, “it is difficult to attribute the widespread damage to the Reflecting Pool to vandalism, let alone to establish that fact beyond a reasonable doubt.”
U.S. Attorney Pirro also directly blamed the Interior Department for providing “less than fulsome information at the outset of the case.” She stated that had the Interior Department been forthcoming, “the government would not have sought a grand jury indictment.” This accusation highlights a severe breakdown in inter-agency cooperation and transparency at the highest levels of government.
Interior Secretary Doug Burgum immediately defended his agency on X, countering Pirro’s claims. He wrote that “the evidence is clear, vandals have repeatedly caused damage to the Reflecting Pool.” Burgum asserted that his department provided the U.S. Attorney’s office with “expert and eyewitness testimony to the damage done by vandals” and “every piece of evidence they asked for in the requested time line detailing each area of damage at the pool.”
The Cost to the People
David Hearn’s legal team, while welcoming the dropped charges, criticized both President Trump and U.S. Attorney Pirro. They announced they were weighing “legal remedies” for their client, stating, “Trump is mad at Pirro because she finally admitted what we made clear in our legal filings all along: Trump’s botched renovation was responsible for the damage — not Davey Hearn.” The team dismissed Pirro’s claim of being “duped by Interior” as “nonsense,” arguing their motions had repeatedly shown the administration’s culpability for the failures.
President Trump had announced plans to beautify the Reflecting Pool in May of the same year. Virginia-based Atlantic Industrial Coatings was awarded the $14.7 million no-bid contract to repaint and waterproof the concrete floor. The pool was drained, and Trump directed that the bottom be painted with what he called “American flag blue.” Problems, including chunks of the new liner peeling off, emerged within days of the project’s completion, leading Trump to quickly blame vandals. The National Park Service had reported a June 9 incident to the U.S. Park Police, claiming a sharp knife or razor cut the pool’s new liner.
This dispute over the Reflecting Pool underscores President Trump’s personal investment in the saga, as he has repeatedly cited the incident as an example of vandalism against federal property. He has used the controversy to advocate for tougher punishments and more aggressive prosecutions, framing the damage as an attack on national symbols. The incident occurred amidst other significant projects spearheaded by Trump in the nation’s capital, including the demolition of the White House’s East Wing for a $400 million ballroom and plans for a towering arch between the Lincoln Memorial and Arlington National Cemetery. The ongoing institutional infighting and the substantial cost of a failed renovation leave the public questioning the stewardship of national heritage.
